Welcome to Mamazzita Gastro Bar. These Terms of Service ("Terms") govern your access to and use of our website located at https://mamazzita-app.vercel.app (the "Site") and any related services we offer, including reservations, text messaging, and online ordering. By using the Site or any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

2. Eligibility

By using our Site or making a reservation, you represent and warrant that you are at least 18 years old (or the age of majority in your state) and have the legal capacity to enter into a binding agreement. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity.

3. Reservations

We accept reservations for dining and special events. All reservations are subject to availability. We reserve the right to decline or modify any reservation for any reason, including but not limited to capacity, previous misconduct, or violation of these Terms. A valid credit card may be required to secure a reservation.

No-Show & Cancellation Policy: We understand plans change. Please cancel or modify your reservation at least 2 hours before your scheduled time to avoid a no-show fee. Late cancellations or no-shows may result in a charge per guest, as disclosed at the time of booking.

4. VIP/Bottle Service Deposits

For VIP seating, bottle service, or large party reservations, we may require a deposit. This deposit is non-refundable within 48 hours of the reservation time. Deposits are applied toward your final bill. We reserve the right to modify deposit policies at any time with notice.

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

Our Site and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Mamazzita Gastro Bar and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, Florida. You consent to the personal jurisdiction of those courts.
